In September 2018, I wrote a blog about the death of the beloved Queen of Soul, Aretha Franklin.  At the time of her passing, no will was found.

Survived by her four sons, her estimated worth was $80 million (£62 million).  Under Michigan state law, without a will her estate would be divided by the courts equally among her children, having divorced 2 husbands.

But at the end of 2019, the tragic tale took an extraordinary twist.

A handwritten will was located.

Under a sofa cushion……

Her legal team have since confirmed that in fact 3 wills have been discovered.  These wills are all handwritten and have been examined by hand writing experts.  Their validity is still in discussion.  As is the intention of the wills, for they all name different executors.

Nearly 2 years later Aretha’s legacy is still in dispute.  Whilst the courts debate the validity of the 3 wills, no beneficiaries are entitled to anything.  If these wills are ruled invalid, the rules of intestacy of the state in which she resided and died will distribute her estate.

To avoid a protracted probate and ensure that when you die, your wishes are enacted quickly and efficiently you must have one legally binding will stored safely.  Your executors must know its whereabouts, if not its contents.  It must be up to date and legally executed.
