If you have been lucky enough to live in more than one country or inherited assets in another country, you may be wondering how many wills you will need when you die.

I am often asked to draft an ‘international will’.  I am usually asked by people with a complex web of assets or a blended family.  They want a simple solution to what is often the most complex of cases.

Is there such a thing as an international will?  There was an attempt to simplify will writing across the globe in 1973 but very few countries have signed up to the Uniform International Wills Act.  Therefore if you are living abroad or have geographically diverse assets, it is unlikely that the will is going to be recognised everywhere you need it to be.

So how many wills do you need?  Each individual’s case is obviously unique, but there are some general rules that you can begin thinking about.

  • If you have immovable assets, like property or land, you will need a will under the law of the country in which it is located
  • If you are resident in or originate from a country with forced heirship, you will need to undertake some estate planning
  • Wills not only have to meet the law of the country assets are located in, but their language as well!
  • If you are resident in or originate from a country with death tax, a will can allow you to minimise the impact on your beneficiaries and maximise your legacy.
  • If you are resident in or originate from a country which requires a will is notarised, you may have to meet that requirement within the country concerned.
