Post death challenges to your will – should you be worried?

In the past 10 years, challenges to wills in the UK have risen dramatically.  There are many socio-economic factors for this.  Families are becoming more complex and often international, property values are soaring, media is making people more aware of the possibilities.

Should you be worried?

Well if you are working with a competent will writer, they should be giving you peace of mind.  They should be working to protect your estate and ensure your legacy is delivered.

What should you be thinking about when working with your willwriter?

Family obligations – If you have remarried, have been widowed or have an extended family, you may have support obligations that you must honor in death as in life.  The Inheritance (Provision for Family and Dependants) Act 1975 is being cited more regularly in cases by family members who may feel that they have not received what they deserve from a relative.  158 cases were filed in 2016.

Trusts – if you have specific wishes and want to exercise some control from the grave, you might want to look into trusts as an option.  A willwriter and a financial adviser can assist you in creating a legal and financial framework for your descendants.

Dementia – According to the Alzheimer’s Society there are “around 850,000 people in the UK with dementia. One in 14 people over 65 will develop dementia, and the condition affects 1 in 6 people over 80. The number of people with dementia is increasing because people are living longer.”  If there is a history of dementia in your family, your willwriter should be advising you about power of attorney as an option to protect the decisions you are making now should you lose capacity.

Execution – proof that your will has been signed according to the law and that you had full capacity to do so is important in preventing claims of this nature.  If the person who drafted your will can be a witness, this will add credibility to the signing process.
