Occasionally a family feud or personal agenda can manifest in a will.   When US business man Frank Mandelbaum’s will was read in 2007, he used a trust to effectively disinherit his gay son by creating an impossible gift.

In the will it was discovered Frank had left a $180,000 trust fund for his grandchildren.  But there were conditions to the inheritance.  The will stipulated that his son Robert’s children would be excluded unless Robert agreed to marry the child’s mother within 6 months of the child’s birth.

Robert had a son in 2009, 2 years after his fathers death.  He is raising his son Cooper with his partner Jonathan.  They wed in 2011.  Cooper has no biological mother listed on his birth certificate, Jonathan is listed as the partner/mother.

Robert is a Manhattan Criminal Court Judge and he brought a challenge to the highly contentious will in 2012.  Robert is fighting to overturn his father’s will on discrimination grounds.  The petition highlights that Frank was accepting of the relationship during his lifetime and there appears to be no explanation for the hurtful final wishes.

The will has created a legal quagmire.  Is it legal to dispose of your own property in a way that is discriminatory?  Can it be enforced when it breaches public policy?  All that is known at this time is that it is going to be a long and expensive legal battle to resolve.
