If you are thinking about writing a will, it is likely that the internet will be your first port of call. Type in ‘online will’ and you will receive thousands of results offering free wills, cheap wills, do it yourself wills…. If you are more old school, a walk down your local high street will allow you to purchase a will pack you simply need to fill in and execute to provide you a will. For £20 you have secured you legacy. Or have you?

Compared with a solicitor fee of £200-£500 for a basic UK will, it would appear an attractive saving to write your own will. For some people, with a small estate and a simple life, a DIY will suffice. However, the Co-operative Legal Services (CLS) research in 2015 revealed that poorly drafted or ineffective DIY wills are to blame for a prolonged probate ordeal for around 38,000 families a year. As the definition of a traditional family expands and populations become more transient, a simple life requiring a simple will is becoming less common.

Extended probate due to an invalid will is expensive. It can absorb around 10% of the estate – a hefty amount for any size of estate. For a UK estate of £150,000, that could be £15,000 which can be easily avoided. So if you own a business, have assets internationally, reside out of your domicile or expect a hefty tax bill – can you afford not to have professional guidance with your will?

A one time, cheap will is exactly that – for that specific point in time. Births, deaths, marriages, divorces – all these life changing events will require you to rethink your will. For a small investment in your will now, and throughout your life changes, you can avoid a distressing and costly experience for your grieving family.
