Having discussed what your executor needs to do in a recent post, now we turn our attention to suitable candidates. Who do you trust to carry out your dying wishes?

Even in simple cases, it can take months and incur considerable expenses to wind up an estate so you need to consider this appointment carefully.

Most people choose their spouse, children or other family members, however if you are a long distance from your family or you are the youngest member this can be an issue – they need to be around to act! There can also be issues with family politics and disagreements. Consider if the person you select is really going to act in your interest in a difficult family dynamic.

For expats, dealing with local officialdom, law and custom could be difficult, so you may want to consider someone with an understanding of your current resident country.  Asking a relative from your country of origin may not be a realistic expectation. You may also need to consider someone with local language and law skills if your assets have required a will in your current country of residence. This may be the will writer or associated law practice.

If your estate is large, geographically diverse or there are family politics at play, you may want to consider a professional, such as a lawyer or specialist firm. For some circumstances creating a team of family and professionals may be the answer, particularly if your will creates a trust. Which is a whole other blog……
